Acceptance of Terms

By accessing or using devfruit.net or any service built and operated by DevFruit ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our site or services.

Description of Services

DevFruit is a software studio based in Des Moines, Iowa that provides business automation, AI workflow solutions, and custom web platforms for small businesses, nonprofits, and event organizers.

Services include but are not limited to: custom software development, event vendor management platforms, contact and inquiry handling, and automated workflow tools. Specific terms for individual client engagements are governed by separate written agreements.

Acceptable Use

You agree not to:

  • Use our site or services for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorized access to any system, account, or data.
  • Submit false, misleading, or malicious content through our contact form or any other channel.
  • Reverse engineer, decompile, or attempt to extract source code from any DevFruit-built software.
  • Use automated tools to scrape, crawl, or overload our site or infrastructure.

SMS / Text Messaging

Certain DevFruit-operated platforms send SMS/text messages to users who have opted in. By opting in to SMS communications through a DevFruit-operated service, you agree to the following:

  • You are the account holder or authorized user of the mobile number you provide.
  • You consent to receive transactional text messages related to the service you enrolled in (event notifications, confirmations, and coordination alerts).
  • Message and data rates may apply, depending on your carrier and plan.
  • Message frequency varies by use case; see our Privacy Policy for details.
  • You may opt out at any time by replying STOP to any message, or contact us at hello@devfruit.net for assistance.

We do not use SMS communications for marketing or promotional purposes. Mobile numbers collected for SMS opt-in are not sold, rented, or shared with third parties for marketing.

Intellectual Property

All content on devfruit.net — including text, graphics, logos, and software — is the property of DevFruit or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Third-Party Services

Our services integrate with third-party platforms including Stripe (payments), Twilio (SMS), Google Cloud (file storage and email), and Microsoft (email infrastructure). Your use of those services is also subject to their respective terms and privacy policies. We are not responsible for the practices of third-party providers.

Disclaimers

devfruit.net and all DevFruit services are provided "as is" and "as available" without warranty of any kind, express or implied — including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that our services will be uninterrupted, error-free, or free of harmful components. Use of our services is at your own risk.

Limitation of Liability

To the fullest extent permitted by law, DevFruit and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our site or services — even if we have been advised of the possibility of such damages. Our total liability for any claim arising under these Terms shall not exceed the amounts you have paid to us in the three months preceding the claim.

Indemnification

You agree to indemnify and hold harmless DevFruit and its owner from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of our services, your violation of these Terms, or your violation of any third-party rights.

Governing Law

These Terms are governed by the laws of the State of Iowa, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Polk County, Iowa.

Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of our site or services after changes are posted constitutes acceptance of the updated Terms.
